Terms & conditions

These terms apply to bags left with DROP Luggage Storage, operated by Motornet Sdn Bhd at Kinabalu Daya Hotel. If anything here is unclear, ask at the desk before you leave a bag — or message us.

Who you are dealing with

DROP Luggage Storage is operated by Motornet Sdn Bhd (199701010650 (426146-W)), which also operates Kinabalu Daya Hotel. When you leave a bag with us, your agreement is with Motornet Sdn Bhd.

We store bags at the Kinabalu Daya Hotel front desk, Lot 3 & 4, Block 9, Jalan Pantai, 88000 Kota Kinabalu, Sabah, Malaysia.

What we do

We take your bags into our care for the period you pay for, keep them in a locked storage room with restricted staff access and CCTV, and return them to you when you come back with your claim stub.

We are responsible for taking reasonable care of your bags while they are with us. We do not routinely open them, and we do not know what is inside unless you tell us. We may need to open a bag to identify its owner if a claim stub is lost, to deal with something leaking or unsafe, or if an authority requires it — and we do that with a second member of staff present and a note in the log.

What we cannot accept

Please do not leave the following with us. Take them out of your bag before you hand it over, and ask at the desk before leaving anything you are unsure about:

Cash and currency · jewellery, watches and precious metals · passports and identity documents you will need · medication you may need during the day · laptops, cameras and other high-value electronics · perishable food · live animals · anything flammable, explosive, corrosive or otherwise dangerous · anything illegal.

If you need to store something valuable, tell us before you leave it. We will tell you honestly whether we can take it. If we do not say yes, we have not accepted it.

We may refuse any item, and we may ask what is in a bag before accepting it.

Your claim stub

Every bag is tagged, and you are given a claim stub. Bring it back to collect. The stub is what lets staff match a bag to the person collecting it, so keep it safe and do not photograph it for other people. We may ask for identification, and we may hold a bag while we check, if anything about a collection does not look right.

If you lose your stub, we can still return your bag, but you will need to satisfy the person at the desk that it is yours — identification, and a description of the bag and its contents before it is opened. We may take longer, and we may decline if we are not satisfied.

Paying

Payment is taken at the front desk when you drop off, for the period you tell us. We accept cash in ringgit, credit and debit cards, and e-wallets including GrabPay and Boost.

If you collect later than the period you paid for, the extra time is charged at the same rates you were quoted when you dropped off. We write the rate for extra time on your receipt at the same moment, so it is fixed before you leave. We do not reprice a bag that is already with us.

Bags left behind

If a bag is not collected, we will keep it and try to reach you on the contact details you gave us.

We will keep trying to reach you on the number you gave us at the desk. If a bag is still with us 30 days after the period you paid for, we will review it and take advice on what we are lawfully allowed to do next. We will go on taking reasonable care of it while it is with us. We will not treat a bag as ours to dispose of simply because time has passed.

We would much rather return your bag. If you are delayed, message us on WhatsApp and we will hold it.

Our responsibility, and its limits

We take reasonable care of your bags, and we are responsible if we fail to and your property is lost or damaged as a result. Nothing in these terms removes rights you have under Malaysian consumer law.

Some things are not down to us: damage that was already there when you handed the bag over, wear to handles, wheels, straps and zips from ordinary handling, and loss caused by events genuinely outside our control such as fire, flood, or the act of a public authority. None of that applies where our own failure to take reasonable care caused the loss or made it worse. If we handled your bag badly, the fact that it was open, or that you had not told us what was inside, does not put it beyond our responsibility.

Please check your bag when you collect it and tell us as soon as you can if something is wrong. Telling us early helps, because CCTV is recorded over after a few days — but noticing something later does not mean we will not look into it. Once you report a problem we stop that footage being overwritten.

Refusing or ending storage

We may refuse to store an item, or ask you to collect one early, if we believe it is unsafe, illegal, leaking, infested, or a risk to other property or to our staff. If we ask you to collect early, we refund the unused part of what you paid.

If we are required by the police or another authority to hand over an item, we will comply, and we will tell you if we are permitted to.

CCTV and your details

The storage room and the front desk are covered by CCTV, and we keep a record of each bag taken in, which includes your name and a contact number.

We use those records to return your bag to the right person and to keep our accounts. We do not sell them or use them for marketing.

General

These terms are governed by the laws of Malaysia. If we cannot settle something between us, the Malaysian courts can hear it, and the Tribunal for Consumer Claims may be able to, within the limits of what that Tribunal is allowed to decide.

These terms apply to bags left with us from the moment this version went up. If your bag was already in our care by then — including one you left earlier the same day — the agreement you made at the desk still stands, and so does the price you were quoted. We will not rely on the older wording that disclaimed all responsibility for loss, capped it at RM300, or allowed us to dispose of a bag after three days. If we change these terms again, we will say when the change takes effect.

What you pay never changes after you have handed a bag over. The rate you were quoted at the front desk is the rate, for the period you paid for, whatever these terms say afterwards.
